General conditions+ of Rotho Italia Srl
Our deliveries are made exclusively on the basis of these general conditions (GTC). These GTC apply to the processing of all orders placed via the Internet at Rotho Italia Srl. These GTC are considered accepted by the customer at the latest upon receipt of our goods.
Our online product offers are valid only while they are visible on the site and while supplies last. The images shown on the website are for illustrative purposes only and are not binding.
- Contract formation
Our offer on the Internet does not constitute an offer in the legal sense, but is rather an invitation to make an offer. With the final order confirmation, we are sent a binding offer to conclude a purchase contract. You will immediately receive an email from us regarding receipt of your order. Acceptance of the order and therefore the stipulation of the contract occurs by sending an order confirmation with the tracking number of the package after shipment. In the case of advance payment, we confirm the conclusion of the contract by sending our account details.
All offers are subject to change. We are free not to accept an order for any reason and to refuse to confirm it. We reserve the right to make changes to prices and product ranges at any time. Deliveries will be made only if the delivery and billing address is located in Italy. There is no minimum order value.
If after order confirmation it is determined that delivery cannot be completed because some products are currently unavailable, we will inform the customer in writing of a new delivery date.
- Prices and shipping costs
All prices include statutory sales tax or value added tax.
Delivery is free for orders over 50 euros.
For orders under 50 euros, delivery costs 4.90 euros.
- Delivery time
All deliveries are made within 6 working days. If an item is not available in stock, we will immediately inform you of the new delivery date.
- Terms of payment
Payment will be made at our discretion via prepayment, Paypal, credit card. The invoice amount will be charged after sending the order confirmation with the Track & Trace number. We reserve the right to deliver goods only upon advance payment. In case of payment on account, the customer undertakes to pay the invoice amount within 14 days of receiving the goods. In the event of late payment, we reserve the right to charge a reminder fee. The right of retention can only be exercised to the extent that the complaints arise from the same contractual relationship.
It is not possible to make payments in cash or by check. Liability in case of loss is excluded.
- Retention of title
The delivered goods remain our property until full payment. The customer is responsible for facilitating the necessary measures to protect our property. In particular, upon conclusion of the contract, the customer authorizes us, at his own expense, to register or annotate the retention of title in public registers, books or similar in accordance with the relevant national regulations and to fulfill all formalities in this regard.
- Return rights and instructions
The consumer, i.e. a natural person who concludes the purchase for a purpose not attributable to his independent commercial or professional activity, can exercise the right of return described below. This does not apply to products made to measure according to the customer's specifications.
You can return the goods received without giving any reason within 30 days. The period begins upon receipt of these instructions in writing (e.g. by letter, fax, e-mail), but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery) nor before we have fulfilled our statutory information and other obligations. Only in the case of goods that cannot be sent via postal parcel (e.g. bulky goods) is it possible to declare the return also by requesting the return in writing. A timely shipment of the goods or a request for collection of the goods is sufficient to meet the deadline. In any case, the return will take place at our expense and under our responsibility. Consequences of the return
If the return is successful, the services received by both parties will be returned and the benefits obtained will be transferred. In the event of deterioration of the goods and for benefits (e.g. benefits of use) which cannot be returned or which can only be returned in part or in a deteriorated condition, the customer is obliged to pay a fee. Compensation is due for the deterioration of the good and for the benefits obtained only if these are due to a manipulation of the good that goes beyond the proof of its properties and functionality. By "property and functionality testing" we mean the control and verification activity of the respective products that is normally carried out in a shop. You must fulfill your payment repayment obligations within thirty days. The customer's term begins with the dispatch of the goods or the return request, for us with the receipt.

- Warranty and right of replacement
The warranty provisions established by law apply. In case of defects in delivery, please contact our customer service immediately via email (firstname.lastname@example.org). Customer service will send a return label within two to three days. Shipping for the return of defective products is free. We replace defective products. If in exceptional cases the return proves impossible or unreasonable, we will refund the purchase price already charged.

- Jurisdiction, applicable law, separation clause
If you are a merchant, a commercial company or a legal person under private or public law or a special fund under public law, the competent court for all disputes arising from or in connection with the contractual relationship is the registered office of Rotho Kunststoff Gmbh. However, we are also entitled to take action against you at your place of residence or registered office or in any other forum permitted by law. In the event of disputes arising from contracts stipulated with consumers, it is possible to act at the domicile or registered office of one of the parties.
All legal relationships between us and the customer will be governed by Swiss substantive law, to the exclusion of the United Nations Convention on the International Sale of Goods (CISG). If you are a consumer, the legal provisions of the country in which you have your habitual residence also apply and cannot be waived by agreement.
The possible invalidity of individual provisions of these GTC does not affect the validity of the remaining clauses.
